Essay --
Looking back throughout American history and research being done Chinese Americans throughout time has been discriminated greatly by our country and own government. Most Chinese immigrants started to arrive in our country in the late 19th century. Not many of them early on were able to get a good or steady job. The early immigrants mainly worked as laborers and in the mining industry. Even working in the lower class jobs they were discriminated by the white people they were working with. Making it hard enough to keep the low paying job they had already. In response to this the 1868 Burlingame Treaty was created for equality between the Chinese and white laborers (Rivero, Chen, Huynh, Peterson, Lasky, 2010). Even with the passing of this treaty it did not change much for Chinese immigrants. They still dealt with discrimination while at work causing a lot of them to lose or quit their jobs (Rivero, Chen, Huynh, Peterson, Lasky, 2010). What made it even harder at the time newspapers an d churches were rallying people together declaring this as a whiteââ¬â¢s only land; Because of these rallies and newspapers it made the previous treaty that was passed seem non existent (Rivero, Chen, Huynh, Peterson, Lasky, 2010). A little part of a bright point in American history for Chinese immigrants was during the time of the Civil War. There were not many that served in the war, but for some of the known few that did and survived through got some good out of it. There were Chinese that served for both the Union and Confederacy (Cohen, 1984). A lot of blacks were not accepted to serve in a white regiment and had to serve in their own little private one. Chinese Americans though did not deal with some of that discrimination; a lot of the white soldi... ...% of the United States population (Chen, 2002). Another thing to is, that even though the population in Chinese Americans is increasing a lot of the Chinese culture is being decreased. They are becoming more ââ¬Å"Americanizedâ⬠one would say (Chen, 2002). It is mainly going on in the youth of the Chinese Americans. They are adapting to our countries culture more today than ever (Chen, 2002). Our country as a whole has improved a lot in accepting the Chinese Americans in to our culture today. When looking through our countries history it is easy to see how much the Chinese were not welcomed in America and the Government did as much as possible to keep the population as small as possible in our country. Over time though our government began to realize about how this was not right and revoked a lot of treaties and passing new ones that were in favor of Chinese Americans.

Jeremy Kassissieh Essay
Itââ¬â¢s new, itââ¬â¢s realistic and itââ¬â¢s an amazing story that will raise your expectations. Puffin books presents to you, The Fifth Quest. This fantastic book has to definitely be one of my favourites. I really enjoyed how this fantastic writer Debra Oswald, tried to express her extraordinary ideas. Before I read this book, I never really liked books of this genre. But something changed; this book has made an impact on my interest because of the way it is written, it is very different to other books. This book would be classified in the dramatic genre. This novel is about two ordinary girls, who are die-hard fans of ââ¬Å"Questsâ⬠. So Nadia, a wishful actress forces Rosie to come for her support. Rosie is amazed when she scores the dream role of being Maya, who is the apprentice of Ashtari. As a result, Rosie soon becomes a major star and starts to adapt to show business. She and Nadiaââ¬â¢s friendship is wearing out and they soon realise that there is no communication between them. But Rosie discovers that show business is cruel at times. And she finds herself wrapped in misery. But through all of that pain Rosie is guided by her friends and mother. Rosie manages to restore her life back to its genuine state, including her friendship with Nadia. Through the book you are taken on a journey of the actual show and reality. This book is written so well that it makes every use of your own imagination. There are many unique themes that run continuously throughout this book. Some of these themes include, jealousy, trusting others, betrayal and friendship and its importance. In this brilliant novel, these themes are explored rapidly. Jealousy, in the story would be classified as the main them. Jealousy is played when, ââ¬ËAnita Hardy tries to get rid of Rosie. Anita is very jealous of Rosie starting to build up fame, so she talked Rick La Spina (producer of the Quests) to cut Rosieââ¬â¢s scenes short. ââ¬â¢ Jealousy is played, where ââ¬ËNadia was informed that Rosie scores the dream role of being Maya. Nadia is extremely disappointed and at the same time very jealous, because she did not get the role she wished for. ââ¬â¢ Another significant theme that runs through the book is, trusting others. In the novel youââ¬â¢ll notice as you read on, Rosie trusts Neil Tesich with all her heart. Neil is an extraordinary friend that a person could ever wish for. In the story Neil acts like Rosieââ¬â¢s mentor. When a difficult hardship crosses Rosieââ¬â¢s way, Neil was always there to ease the pressure. Oswald developed Rosieââ¬â¢s character by making her trust Neilââ¬â¢s advice. By Rosieââ¬â¢s friendship with Neil, it gave her a different point of view in life. In my opinion, I believe Neil is a mature role model to all people of all ages. I immensely enjoyed how the writer portrayed every character in their own way. Anitaââ¬â¢s features include her being worthy at some stages, caring, immature, rich and jealous. A good way to think of Anita is summarised through these words, spoken by the Neil Tesich character ââ¬â ââ¬Ëeven though there are bad features that Anita displays, she is still not a bad person. She just has a lot going on with her life. ââ¬â¢ Oswald developed Anita as a very busy person, who always developed side-affects due to heavy workloads. This outstanding writer, Debra Oswald has significantly made an impact on my interest. She has successfully achieved this, because of the way this book is written. The Use of metaphors, similes and repetition was used in an outstanding manner. There are many more great techniques that this writer composed in this novel. By her completing this, it greatly portrays the actorââ¬â¢s movements throughout the book. As a result of this, the way the book is written, made it so unpredictable for you to uncover what will happen. This really grabs your attention and it definitely inspires you to read more. To me, it is in my opinion that the whole novel is great. I was very entertained while I was reading this novel. The reason for this is that the writing is very satisfying as well as suspenseful. Evaluating my most favourite part of the book would be exceptionally difficult. Overall, to choose my most favourite part of the novel, it would definitely have to be the part where Rosie and Nadia were at the set, at the same time. I particularly enjoyed reading this part of the novel because it is very descriptive and also exceedingly suspenseful. By reading this novel, it can teach children and adults many things. Some of these things include: making correct decisions in life, how to make a positive relationship and how to trust others. Overall I enjoyed reading this book and I will look forward to read more of Debra Oswaldââ¬â¢s novels. So I would recommend that you read it to, because I know you will be impressed.

4 Step Process to Contract Law Essay
Question a) Step One The principle of law is that for a valid contract to be formed there must be an agreement reached by both parties. Step Two There are three main elements for the formation of a legally binding contract, intention, agreement and consideration. The requirement that requires discussion here is the existence of an agreement by the parties to enter into a legally binding contract. An agreement means a consensus on at least those essential terms needed for a workable transaction. The process of reaching an agreement is generally analysed as involving an offer and acceptance. Where the offer is a clear indication of the terms upon which a person is prepared to be bound, and an acceptance is assenting to, agreeing, or receiving the terms offered. See more: Basic Economic problem of Scarcity Essay The requirements of an ââ¬Ëofferââ¬â¢ must be promissory, such as in Placer Development Ltd v Cth (1969) 121 CLR 353 where what the government had said was not a legally enforceable promise, but had appeared to be one. It must be sufficiently complete, and intended to result in a contract if accepted. The requirements of an ââ¬Ëacceptanceââ¬â¢ to exist must be in the same terms of the offer. It cannot still be subject to a condition, such as where it was clear that Cameron had not intended to be bound until a formal contract was prepared and signed, Masters v Cameron (1954) 91 CLR 353. An acceptance must be made while the offer is still in existence. It must be made by a person whom the offer was addressed. If the offer is intended to be made to any person that learns of it then any such person can accept the offer on the stated terms. Carlill v Carbolic Smoke Ball Co (1893) 1 QB 256, where Carlill had read an advertisement offering a reward to anyone who caught influenza after buying the companyââ¬â¢s smoke ball. Carlill bought the ball and caught influenza, since the offer was made to ââ¬Ëthe world at largeââ¬â¢ it is capable to be accepted by anyone who learns of it, including Carlill. An acceptance must be made in acceptable form. In the case of emails, it is considered to have been received when it reaches an information system designated by the person to whom the email is addressed via s 13 electronic Transactions (Victoria) Act 2000 and equivalent legislation in other stated and territories. For the process of offer and acceptance to result in agreement, the terms of the offer must be accepted without suggesting changes. For example, in Olley v Marlborough Court Ltd (1949) 1 KB 532 Olley had her furs stolen in the hotel, and there was a notice in the room notifying that the hotel was not held accountable for stolen goods. This notice was not part of the agreement as it was not in the initial contract and therefore the hotel was made liable. Step Three The review of whether an agreement has been reached between both parties involves determining the requirements of an offer and acceptance have been met. Firstly, for an offer to exist, it must be intended to result in a contract is accepted. The advertisement made by Games Travel Ltd is not viewed as an offer by the courts because advertisements are not intended to signal a readiness to be bound, but rather an invitation asking customers to make an offer to buy. Secondly, for the requirements of an acceptance to exist, it must be in the same terms of the offer. If the advertisement were to be seen as an offer, the terms agreed on would be $1000 for the tickets and tickets to the finals in swimming, archery and gymnastics. Jon only authorized the payment of $1000 as the terms on the offer expressed. As the terms had changed after he had authorized payments, there were no tickets to the gymnastics, which made the offer invalid. Lastly, for the process of offer and acceptance to result in agreement, the terms of offer must be accepted without suggesting changes. The change from $1000 to $2000 breached this requirement. An attempt to accept an offer on different terms should have been constructed as a rejection of the original offer and the making of a counter-offer. Step Four Due to not meeting the requirements of an ââ¬Ëofferââ¬â¢ through not being intended to result in a contract if accepted, and not meeting the requirements of an ââ¬Ëacceptanceââ¬â¢ by not being in the same terms of the offer, there is no legal binding agreement between both parties and Jon is not obliged to pay $2000 for the plane tickets as there is no authorization for $2000, rather $1000. Question b) Step One The area of law relevant to this question is the review of a contents of a contract enforced between two parties. Step Two There are particulars to a contract which structure its existence. This includes the importance of terms within the contract, the freedom of contract, statements that do not become part of contract, and terms of contract. Within a contract consideration must be made to the creation of the contract. The terms of the contract define the obligations of the parties. It is by analysing the terms that you can find out what has to be done to discharge those obligations. For example in Cehave NV v Bremer Handelsgesellschaft mbH [1976] QB 44; [1975] 3 All ER 739, the buyer Cehave did not want to accept the delivered goods because they were not in ââ¬Ëgood conditionââ¬â¢ although they were in satisfactory condition to perform their purpose which was to be used as animal feed. Freedom of contract is the freedom of individuals to bargain among themselves the terms of their own contracts, without external interference. People can negotiate effectively in their own interest and both parties negotiate from a position of equal strength. Limits included on freedom of contract are illegal undertakings not enforceable, such as anything more than minimal regulations and taxes may be seen as infringements. Policy considerations may limit freedom of contract. There are certain statements that do not become part of the contract but are said in negotiations. This includes puffs, opinions and representations. Puffs are statements of exaggerated praise to excite buyers and encourage sales and are without any real or measurable substance. Opinions are statements of personal views or beliefs and should not be relied on as it may be incorrect. If a person misrepresents their true opinion, their statement is treated as a representation. Representations are statements often made to encourage the other party to enter the agreement, without intending that they be contractual promises. For example Oscar Chess Ltd v Williams [1957] 1 All ER 325, the car dealer sued Williams for breach of contract due to the car age document being false. The courts decided the document was a mere representation rather than a contractually binding promise. The terms of a contract describe the entire contents of a legally enforceable agreement. Terms are ââ¬Ëexpressââ¬â¢ when they have actually been declared or definitely stated. There are disagreements over whether particular terms have been included in the contract or not. For example Causer v Browne [1952] VLR 1 the statement on the docket was not seen as contractual terms as it was only an identifying docket. A term may also be ââ¬Ëimpliedââ¬â¢ into a contract when that term was intended to be part of the contract without being expressly stated or referred to. It can only be implied if it is obvious that the parties had intended to include the term as part of their agreement. Implied terms must be reasonable and fair, be capable of clear, unambiguous expression and it must not contradict any express terms. In Codelfa Construction v State Rail Authority of NSW (1982) 149 CLR 337 Codelfa tried to claim extra payment for the extra costs incurred due to stopping and starting work overnight. The courts rejected this as there was no such term implied that would see unforeseeable stoppage to work and compensation paid out. A breach of contract that causes loss gives rise to a claim for damages. If sufficiently serious, a breach may justify a claim to damages plus a refusal to accept performance. To evaluate the seriousness of a breach various terms are distinguished and some terms are described as ââ¬Ëconditionsââ¬â¢ and the others ââ¬Ëwarrantiesââ¬â¢. Conditions are terms of fundamental importance to the agreement, whereas warranties are terms of lesser importance than conditions. In a breach of condition an injured party can terminate contract and/or sue for the damages. Whilst in a breach of warranty the injured party can sue for damages. In Associated Newspapers Ltd v Banks (1951) 83 CLR 322 Bancks, the cartoonist had the right to terminate his contract as the promise to publish Blancks drawingââ¬â¢s on the front page of the comic section was a condition term. Step Three Identifying the content of the contract between Jon and Games Travel Pty Ltd shows that there are express terms that exist within the contract. For example, the two tickets for the price of one, and the tickets to the finals in the swimming, archery and gymnastics. These terms are contractual terms and must be carried out as specified by the agreement. The terms sought throughout the contract are categorised as warranties, as they are not terms of fundamental importance. Such terms are the swimming tickets, where Jon had received menââ¬â¢s event and not the womenââ¬â¢s. Also, the ticket price was doubled when charged, the initial contract was $1000 which is a warranty term. Terms that are conditional are the actual flight to the Commonwealth Games in India. Breaches of Warranty terms such as the swimming ticket and $2000 charge would be a breach of contract. In such a case, the remedy available for breaching warranties are to claim for damages only. This would include $1000 which Jon was overcharged. Step Four In conclusion, through analysis of the contents of the contract a breach of warranty has arisen. The remedy of such can include a sue for damages incurred.

Cultural and Ethnic Diversity Essay
The different beliefs, characteristics and looks of different ethnicities give more diversities in a place. The differences in cultures create color in every region. It allows people to understand each other and respect each otherââ¬â¢s differences and beliefs. On the other hand, these differences are emphasized too much that instead of being the key to a harmonious living, leads to gaps, differences and even fights (Singelis 4). In a certain region, diversity is inevitable especially in a place like the United States. The United States is the melting pot of many cultures. Over the years, the country has become the destination of people from all over the world to achieve their dream. It seems that each state has its own taste of a different culture. Aside from that, immigrants have slowly settled in the country making it much more diversified. You wouldnââ¬â¢t be surprised that there is a little China Town in every state. There is also a growing number of Muslims in the country. This is a good sign for us as it shows that the war does not hinder our Muslims brothers to reside in our country. They are also given the freedom to stay here whenever they want. Other nationalities such as Filipinos, Indians, Japanese and Koreans have chosen to stay in the Land of the Dreamers. The Americans are known for their quest in reaching our dreams. And that is probably one of their best attributes. It is also probably one of the reasons why a lot of people choose to settle here. They too think that they will reach their dreams by going to America. Despite the diversity that has evolved in our culture, there is still this distinct American taste that is present is the American culture. This distinction in each culture paves way for people to know each other. (Singelis 152) Each culture, ethnicity is proud of its heritage. American families, for example, are very particular in implementing the American culture. American parents taught their children to love their country and have pride that we are Americans. This is, after all, the Land of the Free and the Home of the Brave. Our families teach us to be good Americans by passing on the value of citizenship, American holiday celebrations and traditions, leadership, entrepreneurship, competition and positive attitude. On the other hand, each culture is like that. The media plays a huge role in exposing the differences in each culture. Movies, documentaries all feature distinct qualities of each culture. These differences are somehow exposed in wrong way. Most of the time, cultures are perceived based from what people hear about them. I really think that the differences in cultures and ethnicities are given too much emphasis without being aware of it. In effect, this led to conflicts and gaps between cultures. It is a sad fact that instead of being united especially in these times of crisis, we are still separated by our personal beliefs. The media would be a really good help in promoting unity. It would help if similarities are focused and if people will be taught to respect one anotherââ¬â¢s beliefs too. A good example of this would be the movie Gran Torino. The movie is about an American old guy who lives near a bunch of Hmong people. Hmongs are people from China, Laos, Vietnam and Thailand who came to the United States to find their fortune. They decided to live altogether in one neighbor so that they too can perform their traditions and gather often. The American guy and some of the Hongââ¬â¢s turned out to be true friends and depended on each other. It was good to see the culture of the Hmongs in the movie. It was an eye-opener to many of those who have watched it. The only similarity between the American and the Hmongs was that they both wanted to live peacefully. It happened when they got to know each other and respected their own beliefs (The Gran Torino 1). Movies like Gran Torino should be featured more often. I think it is a good thing to showcase the different distinction of each culture especially the minorities. These minorities deserve their recognition from the world. Maybe with given much time, people should get to know the history, beliefs and traditions of the many cultures and ethnicities especially if they are just in the neighborhood. It is good to know that we are uniting for the sake of living peacefully and harmoniously. Work Cited Singelis, Theodore. Teaching about Culture, Ethnicity and Diversity: Exercise and Planned Activities. California: SAGE Publishing, 1998. ââ¬Å"The Gran Torino. â⬠2008. Retrieved 20 February 2009 .

Trans Fatty Acids and Cardiovascular Disease Article
Trans Fatty Acids and Cardiovascular Disease - Article Example They can cause several diseases including diabetes and CHD. Analysis of evidence derived from dietary trials, experimental research studies, and prospective observational researches leads to the conclusion that trans fatty acids consumed when they are obtained from partially hydrogenated oils yield no nutritional benefits but are harmful for health. Eliminating the use of partially hydrogenated oils from the food products is not easy for the food manufacturers in America, though other countries provide examples of successful replacement of the use of trans fatty acids in partially hydrogenated oils with the use of cis unsaturated fats because this helps the food manufacturers make foods healthier without bearing more cost or compromising upon the quality or quantity of the food products. Health care providers should advocate limiting of the use of trans fats. Reduced intake of trans fat would bring many health benefits for the society and reduce heart diseases in the

INTERNATIONAL FINANCIAL REPORTING Essay Example | Topics and Well Written Essays - 2750 words
INTERNATIONAL FINANCIAL REPORTING - Essay Example International Financial Reporting Standards (IFRS) are touchstones, explanations and the Framework for the Preparation and Presentation of Financial Statements of corporations. The objectives of financial reporting can be bifurcated into General Objectives, Derived Company Objectives, Derived External User Objectives and Specific Objectives. The general objectives of any financial reporting is to provide the present and possible capitalists, creditors and other users with information which may be useful for them to make lucid investment, credit, and comparable decisions. Derived external user objective provides useful information so that potential investors can calculate the amount and time to make their investment. Through the financial statements the investors, creditors and others can assess the future net cash inflows to the company. The specific objectives are to provide the company about its cash flows, its complete income and the various components of such income and also the companyââ¬â¢s economic resources, obligations, and ownersââ¬â¢ equity (Nikolai Bazley Jones, 2009). Even though a printed annual report contains data about programs, new products, proposed capital expending etc., this is normally showed in such a way that it is certainly assorted from the regular financial statements (Mautz and Sharaf, 1961, 170-171). The amount of information which has to be presented should help the users to take decisions and form opinions (Flint, 1982, 15). Apparently too much or too little detail may be detrimental (Mautz and Sharaf, 1961, 170). Flint (1982, 15) states that basic queries in financial reporting are â⬠from which usersà ´ standpoint have the accounts to be consideredâ⬠and what degree of agreement is to be accepted on the part of those who have to figure notions and take decisions. The IASB framework keys out the fundamental concept based on

Teaching of Socrates Essay Example | Topics and Well Written Essays - 2000 words
Teaching of Socrates - Essay Example The three great Socratic philosophers, Socrates, Plato(www.wsu.edu:8080/dee/GREECE/PLATO.HTM), and Aristotle(www.philosophypages.com/hy/2n.htm), were to be "rediscovered" during the Renaissance(www.absoluteastronomy.com/ encyclopedia/c/ch/christendom.htm) and their rational, practical, and scientific ideas were to influence the thinking and the governmental, religious, and educational institutions of the entire western world" it also says that "Socrates was distinct in inculcating ideas on (a) Ethics(www.nd.edu/Departments/Maritain/etext/jmoral01.htm) that that influenced later Greek philosophers (b) Inductive method of reasoning. (www.cs.miami.edu/geoff/Courses/ CSC545-F05/Content/LogicalConsequence.shtml) (c) Imposed Knowledge is happiness. He believed that knowledge or insight is the foundation of virtue (depthome.brooklyn.cuny.edu/ classics/dunkle/studyguide/apology.htm) and happiness (plato.stanford.edu/entries/moral-character/) (d) Rationalism. Thru reasoning, man can reach the truth. His question and answer method, as described below, caused his students and future philosophers to use thinking as a major way of getting to the truth. Future philosophers and Catholic Saints like St. Augustine and St. Thomas Aquinas delved into his virtue, knowledge and happiness theories and expanded and brought to the next level Socrates' theories by adding their own modern day philosophical theories. In the "SOCRATIC METHOD . Athens(web.utk.edu/utfp/eoc/athens/) became the classroom of Socrates. He went about asking questions of authorities and of the man in the street in order to arrive at political and ethical truths. He questioned groups of his students as a means of instruction, to compel them to think a problem through to a logical(www.roangelo.net/logwitt/) conclusion. His dialectic(www.english-test.net/gre/ vocabulary/meanings/031/gre-words.php) method, or method of investigating problems through dialogue discussions, came to be known as the Socratic method. It involved: 1. SOCRATIC IRONY(depthome.brooklyn.cuny.edu/ classics/dunkle/studyguide/apology.htm). Socrates pretended that he knew no answers. His assumed ignorance or willingness to learn from others was the background for adroit questioning to reveal the t truth or expose the error of the answers he received. 2. DEFINITION(www.thefreedictionary.com/definition). The initial question usually required the definition of the concept. 3. ANALYSIS(www.mdx.ac.uk/www/study/glothi.htm - 101k - 28 Okt 2005). Subsequent questions elicited an analysis of the definition in all its implications.4. GENERALIZATIONS(www.friesian.com/founda-1.htm). After examining all of the particular applications and consequences of the concept(radicalacademy.com/philsocrates.htm), Socrates reasoned, or persuaded his students to reason, from the particular to the general, or by the process of induction, to reach a general conclusion". His style of pretending to know
